1. Acceptance

By creating an account or using AffyLink (the “Service”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

AffyLink helps publishers manage affiliate keywords and links, inject keyword links via a first-party tracker on authorized domains, and view click and impression analytics. You remain responsible for your content, affiliate program compliance (including Amazon Associates and other networks), disclosures, and destination URLs.

3. Accounts & eligibility

• You must be at least 18 years old and able to form a binding contract.
• You are responsible for account credentials and activity under your account.
• One natural person or single business entity per account unless we agree otherwise in writing (team seats are not offered at launch).

4. Subscriptions, trial & billing

• Plans: Paid tiers are named Starter, Pro, and Network. Prices and included plan limits are shown on the Pricing page and enforced in-product.
• Trial: New accounts receive a 14-day trial (card not required to start). During trial you receive Pro-tier limits unless we state otherwise.
• Billing: Paid subscriptions are billed via Stripe (Laravel Cashier). Taxes may apply (Stripe Tax). Annual billing is offered where shown (typically two months free versus monthly).
• Grace period: After trial or paid access ends, the widget may continue serving existing keywords for a limited grace window while the dashboard locks — details match current product behavior.
• Plan limits: Domains, links, keywords, impressions, and AI analysis allowances are capped by plan. Soft warnings and hard caps may apply; exceeding caps can block new creates until you upgrade, add capacity, or reduce usage.

5. Refunds

If you are charged for the first time after trial and are not satisfied, contact us within 14 days of that first charge for a no-questions refund of that charge. We do not offer prorated refunds for unused time after that window, or for renewals, unless required by law. Cancel anytime in the billing portal to stop future charges.

6. Acceptable use

You agree not to:

• Use the Service for unlawful, deceptive, or abusive purposes;
• Interfere with or overload the Service, scrape without permission, or attempt to access other customers’ data;
• Inject malware, obscure affiliate destinations in a way that violates network rules, or strip required link attributes the Service applies for compliance;
• Misrepresent your relationship with AffyLink or use our brand without permission.

We may suspend or terminate accounts that violate these Terms or create risk for visitors, networks, or the Service.

7. Your content & affiliate programs

You retain ownership of your keywords, links, and site content. You grant us a limited license to process that data to operate the Service. Affiliate program approval, commissions, and policy compliance are solely between you and those programs.

8. Intellectual property

The AffyLink software, branding, and documentation are owned by AffyLink or its licensors. These Terms do not transfer ownership to you.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS.” WE DO NOT WARRANT UNINTERRUPTED AVAILABILITY, SPECIFIC COMMISSION OUTCOMES, OR THAT KEYWORD MATCHING WILL CATCH EVERY OPPORTUNITY. Analytics reflect events we receive from your installed tracker and authorized domains.

10. Limitation of liability

To the fullest extent permitted by law, AffyLink and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, or data, arising from your use of the Service. Our aggregate liability for claims relating to the Service is limited to the fees you paid us in the three months before the claim.

11. Termination & data

You may delete your account in-product. Soft-deleted accounts are purged after a retention window (see Privacy Policy). We may terminate for Terms violations or operational necessity. Surviving sections include ownership, disclaimers, liability limits, and governing law.

12. Changes

We may update these Terms by posting a revised version. Material changes for paid subscribers will be communicated by email or in-dashboard notice when practicable. Continued use after the effective date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the State of Idaho, USA, without regard to conflict-of-law rules, unless mandatory consumer law in your place of residence says otherwise.
